Your Mattress is covered by a 20-year limited “Warranty” from Meubles En Gros. Once registered, each client is qualified for a 20-year limited guarantee on any mattress purchased straight from meublesengros.ca. Without registration, the standard guarantee is 10 years. You may also have other legal rights, which differ from province to province or state to state, in addition to the particular legal rights provided to you by this limited Warranty.
1. Who this Warranty extends to
This limited Warranty is applicable to the original purchaser of a Product who is situated in Canada “Customer“. The warranty is only effective in the country where the item was purchased. This Warranty also applies to customers who purchase greater amounts for commercial use and who get separate invoices, often known as “Commercial Customers.” All guarantees made by Meubles En Gros, including implied guarantees, are only valid while the product is maintained by the original buyer. The first person to buy the Product directly from meublesengros.ca or another website run by meublesengros.ca is considered the “original purchaser” for the terms of this warranty. The limited Warranty provided by Meubles En
Gros cannot be transferred.
2. Products covered by this limited Warranty
This limited warranty applies to Products sold by Meubles En
Gros that are purchased directly from meublesengros.ca or any other website controlled by Meubles En Gros and are situated in Canada.
Mattress covers—hereinafter referred to as “Mattress Covers”—are also covered by some parts of this limited warranty.
The product is made to work on a flat, hard surface that is supported structurally by a bed frame that can withstand the weight of the user and the product (s).
This Warranty does not apply to your Product if you do not use it in accordance with its intended design and use in the home. This Warranty does not cover moisture damage caused by improper storage or usage of the Product.
3. What this limited Warranty covers
If the product is used for the intended purpose and is still in its original packing after purchase, the following defects in material and workmanship are covered by this limited warranty:
● Deterioration resulting in a visible indentation of more than two inches (three inches for orders placed by corporations and institutions) on the Product, which is not connected to an indentation or sag brought on by the installation of an inappropriate or unsupportive foundation or adjustable bed base. Normal use requires that the Product be constantly supported by an adjustable bed base or foundation that matches.
● Despite regular use and good treatment, any physical fault in the product.
● Any flaw in the product’s manufacturing.
This limited Warranty does not cover the following:
● A typical rise in foam softness.
● Preference towards comfort.
● Physical abuse or damage to the structure and/or cover material, including but not limited to burns, cuts, rips, liquid damage, or stains; provided, however, that such abuse or damage is the source of the fault.
● Unless you are a Commercial Customer, any damage caused by industrial use, such as at a hotel or store, is not covered.
● Replacement of any non-defective parts of the Meubles En Gros goods, such as if you buy a product with numerous components and only one of them is broken. In this case, we will only replace the broken part.
● Products that are marketed as “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” or “previously owned,” or any other phrase implying that the item is not “new” or of “first quality” or that it has already been bought or used by another customer.
In the case of a Defect, meublesengros.ca’s entire and exclusive obligation and your exclusive remedy under this limited Warranty shall be, at meublesengros.ca’s choice, to provide a repaired or replacement Product, subject to your fulfilment of “Your Responsibilities” below. Replacement items may be of a different colour or design than the ones you initially purchased.
4. Your responsibilities
In the case of a Defect, we may need you to return your Product to Meublesengros.ca and submit Meubles En Gros with documentation of the original date of purchase in order to get the benefit of this limited Warranty. As evidence of purchase, you must save a copy of your receipt.
Meubles En Gros will organize for the return of the damaged Product. If you pay any shipping or handling fees in returning the Product, you will not be compensated for those costs.
Evidence of a Defect, as well as any claims, must be forwarded to the address shown at the bottom of this limited Warranty agreement. You must provide multiple images of any damage that is the subject of a warranty claim. The number of photographs required will vary based on the product and the nature of the damage. If a replacement is required, meublesengros.ca will only replace your Item with a similar or identical Product.
If an upgraded Product is requested, you will be asked to pay the difference between your original purchase price of the item and that of a replacement Product, including any extra fees. Meubles En Gros will either fix or replace (as appropriate) your product and dispatch your new or upgraded product to you.
Products that have been replaced or repaired are covered by the same limited warranty as the original product. If you receive a replaced or repaired Product, the warranty period for the replacement or repaired Product begins from the date you purchased the original Product. If you acquire an updated product, a renewed warranty period will start on the date of purchase. The original Product’s legal and care labels must remain on it since they serve as the Product’s identification for the purposes of the warranties stated above. This guarantee is only applicable if you unpacked and expanded your Product within two weeks of its original delivery date.
The Product should not be used on floors that are prone to moisture buildup, such as concrete, below-grade (basement), or in moist areas. Such improper use may cause fungus development on the bottom of the Product, voiding your warranty.
The Product is intended for use on hard surfaces, non-spring foundations, or adjustable bed bases capable of bearing the weight of the Customer’s Product, foundation, and user(s). The Customer must utilize their Product on a base that permits air to circulate beneath it.
It is the duty of the Customer to keep the Product on a good foundation and to give appropriate support. Modification or use of an incorrect foundation or other basis on which the Product is installed may result in product damage, voiding this warranty.
Customers who use a bed frame must ensure that it offers solid support for both the Product and the foundation, including a central support and at least 5–6 legs for queen, king, and California king products, and 4 legs for twin and full products.
Customers utilizing their Product directly on a slatted bed system must guarantee that the slats are at least 2 inches wide and have no more than 3-inch gaps between them. Queen, king, and California king platform beds and slat system bed frames used in combination with your Product must have at least one center support beam.
The Product should not be used with platform beds or adjustable foundations made of wired metal. Measuring Indentations: meublesengros.ca Inc will need the Customer to submit photographs proving the indentation by laying the Product directly on a flat floor and measuring the vertical distance between a flat and level string stretched tightly across the Product, gently touching the Product on opposite sides, to the Lowest Point of the Indentation using a precisely defined measuring instrument.
5. Disclaimer, limitation on liability
The Product is offered “as is” and, to the extent permitted by applicable law, this Warranty and any implied warranties are the only guarantees you have and replace any and all other express or implied warranties or conditions. Because certain provinces/states do not allow restrictions on the duration of an implied warranty, the above-mentioned limitation may not apply to you. Because certain states or other jurisdictions do not allow the exclusion of implied warranties, the exclusions listed above may not apply to you. Depending on the state, province, and jurisdiction in which you reside, you may also be eligible for other rights. To the maximum capacity permitted by current laws and except as stated clearly in this limited Warranty, Meubles En Gros or its suppliers will not be responsible for the procurement of alternative products or other special, incidental, consequential, or indirect damages arising out of or connected to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnification, product liability, or otherwise. This restriction shall apply even if meublesengros.ca has been notified of such damages, and notwithstanding the failure of any limited remedy’s essential purpose. The entire responsibility of Meubles En Gros will not exceed the purchase price paid for the Product giving rise to such obligation. Since certain provinces and states may not permit the exclusion or limitation of incidental or indirect damages, the aforementioned limits and exclusions might not apply to you.
6. Arbitration
If a disagreement occurs between you and Meubles En Gros resulting from this limited Warranty, such dispute will be resolved and settled by mandatory arbitration between the parties in accordance with the Alberta Arbitration Act. Before exercising any rights or pursuing any other remedies provided by any other law or legislation, you must first seek arbitration for any disputes arising out of this limited Warranty. The arbitration will be held in Edmonton, Alberta. The arbitration will not be joined with any other process or arbitration in which one of the parties is involved. Each side will appoint one arbitrator, and the two appointed arbitrators will choose a third arbitrator to act as the panel’s chair. All arbitration processes shall be closed to the public and kept secret, and all relevant records will be permanently sealed, unless court confirmation of the arbitration result is required. The decision and award of the arbitrators will be in writing and will include a statement explaining why any claim was dismissed. A dissenting decision will also be written down. The arbitrators’ decision will be final and enforceable against both parties, and it can be used as legal evidence in any court with the necessary authority.
7. Governing law
This limited Mattress Warranty will be regulated by Alberta jurisdiction.
Your new meublesengros Mattress is insured by a 20-year Limited Warranty with registration.
Once registered as a Meubles En Gros VIP, each client is eligible for a 20-year limited guarantee on any mattress bought directly from Meubles En Gros. Without registration, the average warranty is 10 years. If you suffer a manufacturing problem that is covered by our warranty within 20 years of purchasing your mattress, we will provide a one-time replacement or repair of the original item in the size purchased. All parts of the product are included in this. There is no charge or deductible necessary. Meublesengros will retrieve the original product and deliver the replacement item at no cost to the customer. If the warranty claim occurs within your 100-night trial period, the trial will be paused while the replacement product is dispatched and resumed when it is delivered.
Your Responsibility
The mattress warranty covers the genuine buyer of the mattress for the specified period of time while they are in Canada. Any expressed or implied warranty is only good while the product is being used by the original buyer. For the purposes of this guarantee, the original purchaser is the first buyer of the item from Meublesengros.ca. As validation of purchase, please keep an original copy of the receipt. In order to identify and verify the warranty issue, photos, the lot # (found on the product), and original receipt of purchase may be requested upon a warranty claim.

Replacements
Except as stated above, if a mattress is found to be faulty during the 20-year Limited Warranty period, meublesengros will not charge the buyer to repair or replace the mattress. The replaced item will not come with a new warranty. Replacement product delivery is only available inside Canada.
The decision to approve a warranty is entirely up to meublesengros. Customer’s interpretation of our warranty policy is not applicable.
Disclaimer, Limitation on Liability
To the extent permitted by applicable law, the meublesengros mattress/the hybrid mattress is provided “as is,” and this warranty and any related warranties are your exclusive warranties, replacing all other warranties or conditions, express or implied. The above limitation may not apply to you because some provinces or territories do not allow limitations on the duration of an implied warranty.
A few provinces and other jurisdictions may not permit the exclusion of implied warranties, therefore the above mentioned exclusions might not apply to you. You may also have other rights, which vary by Province and Jurisdiction.
Except as expressly stated in this limited warranty, meublesengros or its suppliers will not be liable for the procurement of substitute products or other special, incidental, consequential, or incidental damages that arise from or are related to the meublesengros mattress.The meublesengros hybrid mattress or its use by you or any third party, whether under theory of agreement, tort (including negligence), insurance policy, product liability, or otherwise.This restriction shall apply even if meublesengros has been notified of such
damages and despite the failure of any restricted remedy’s fundamental aim. The entire responsibility of meublesengros will not exceed the purchase price of the meublesengros mattress/the meublesengros hybrid mattress that gave rise to such liability.
You might not be covered by the above mentioned restrictions and exclusions because certain provinces or territories do not permit the exclusion or limitation of accidental or indirect damages.
Actual measurements for every product from meublesengros may vary slightly. We allow for variations due to different environmental conditions and/or the compressed packing process to be within 1 inch (+/-).
